Colorado Supreme Court Rules on Donald Trump
BREAKING NEWS: 19 December 2023. Colorado is one of the American states. Its Supreme Court has disqualified Donald Trump from the 2024 primary ballot, because of the insurrection clause.
Below is an old post 1 November 2023, about what an insurrection is.
I’m no lawyer, but I keep thinking about Donald Trump’s defence that the insurrection clause of the 14th Amendment, does not apply because he was the president at the time. In fact, he doesn’t refer to himself as was. There’s no past. He will always be president, to himself. Anyway, he maintains the insurrection clause does not apply because he is the president.
The legal technicality is that the clause is not job or career specific. It doesn’t say dog catcher, sheep shearer, farmer, florist, janitor, plumber, banker, hacker or computer programmer. It says ‘any one who has engaged in insurrection or rebellion.’ Secondly, technically, Donald Trump was not U.S. President on 6 January 2021, he was any one.
We can even reverse the car a few miles back, and go to 3 November, the date of the 2020 election. There was no sitting president because Americans were running around, picking up kids from school and voting for the next president. Numbers tumbled in, the Electoral College did its bit, and Joe Biden became the President-Elect. Donald Trump ceased to be the U.S. President. He became any one. He sent the tweet Be there. Will be wild, as any one. Therefore, the insurrection clause of the 14 Amendment fits him like a glove.
The RICO case in Georgia is based on his legal status as any one. He was not the U.S. President.
